ملخص البحث
هو بحث في باب التعارض والرجيح بعنوان: تعارض الـمُقَرِّر والمغيِّر دراسة أصولية وتطبيقية، وقد بدأت بتمهيد بتعريف مصطلح التعارض والـمُقَرِّر والمغيِّر والبراءة الأصلية ، بعدها بينت صورة التعارض بين الـمُقَرِّر والمغيِّر وصياغة العلماء لهذه المسألة، وأين کان مظانها في کتبهم.
ثم ذکرت أقوال العلماء في المسألة مع أدلة کل قول ومناقشتها، ومن ثم قمت بترجيح ما ذهب إليه الجمهور في تقديم المغيِّر على الـمُقَرِّر.
ثم ختمت هذا البحث بخمسة تطبيقات فقهية أثرت فيها هذه المسألة.
Abstract
This study is in the topic of al-t’arud wa al-tarjeh (contradiction and preponderance) under the title: The contradiction of al-mūqarir wa al-mūghayr (the determinant and changer), fundamental and practical study.
In this study, I begin with intruducing al-mūqarir, al-mūghayr, and al-bārā’h al-aslēyah (the determinant and changer, and the initial absolution), after which I illustrate how they are different and mention where and how the Islamic scholars' discuss the subject matter.
Then, I cite their opinions, discuss each of their sayings, and demonstrate what the majority of Islamic scholars went for. I conclude this study with five jurisprudential applications that were affected by this issue.
